Pebble Beach Event Terms & Conditions
  1. As of the date I agree to participate in the event on 04/05/2024 (“Event”), through and including the date of the Event, I represent that I was at least 21 years of age. I further represent that I was not and am not, nor is any member of my immediate family or household, an employee, officer, director or agent of Fetzer Vineyards dba Vina Concha Y Toro (“Sponsor”), any of its parent companies, affiliates, subsidiaries, or any alcoholic beverage industry producers, importers, wholesalers, distributors or licensed retailers.
  2. By participating in the Event, I hereby irrevocably and perpetually agree to be bound by these Terms and waive and release any and all claims which I may have, or which I may hereafter have, whether known or unknown, on behalf of myself, and my heirs, executors, and assigns: Sponsor, including advertising agencies and all others associated with the development and execution of the Event, and their respective officers, directors, employees, agents, parent, subsidiaries, affiliates, shareholders, successors, and assigns (“Released Party”) from any and all claims, demands, lawsuits, expenses, injuries (including death), losses, damages, and any other liability of any kind, of or to me or any other person, my property, or my rights of privacy or publicity, directly or indirectly arising out of or in connection with the Event (including the conduct of the Event, the awarding of any prizes, my participation in the Event), even if due to the negligence, omission, or other fault of a Released Party. I covenant not to make or bring any such claim against Sponsor or any other Released Party, and forever release and discharge the Sponsor and all Released Parties from liability under such claims. This waiver and release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be released by agreement.
  3. I understand that by participating in the Event, I am waiving any and all claims, of any kind arising out of or attributable to the Event, including those claims that may be unknown to me, or which I do not suspect to exist at this time. WITH THE INTENTION OF WAIVING ALL UNKNOWN AND UNSUSPECTED CLAIMS, I HEREBY EXPRESSLY WAIVE ALL RIGHTS, BENEFITS, AND PROTECTIONS I MAY HAVE UNDER CALIFORNIA CIVIL CODE SECTION 1542, WHICH READS AS FOLLOWS:  A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
  4. I have read and opted-in to Sponsor’s Privacy Policy (“Privacy Policy”), which is available at https://vct-usa.com/privacy-policy/ and is hereby incorporated by reference. I consent to the Privacy Policy and terms of use and acknowledge my identifying information may be disclosed to third parties. 
  5. If any of these Terms are held invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms or invalidate or render unenforceable such term or provision in any other jurisdiction.
  6. The Event is governed by the laws of the State of California, without respect to conflict of law/choice of law doctrines of California (or of any other jurisdiction which would lead to the application of the law of any jurisdiction other than California). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in San Francisco, California and I hereby consent to the exclusive jurisdiction of such courts.
  7. I acknowledge and agree that my consent to these Terms is a material inducement for Sponsor to allow my participation in the Event and that Sponsor would not do so in the absence of my consent as evidenced by my attendance at the Event.
  8. These Terms constitute the entire agreement between me and Sponsor with respect to the matters described herein, and supersede any and all other agreements and communications, oral or written, between me and Sponsor or any other Released Party with respect to such matters.
